(UPDATES) THE House of Representatives on Tuesday approved on third and final reading the medical marijuana bill.
House Bill 10439 hurdled the final reading with 177 lawmakers voting for it. Nine were against and nine others abstained.
The bill states that subject to its provisions, access to medical cannabis “shall be allowed for medical use by qualified patients.”
A qualified patient is someone who an accredited doctor has diagnosed as having a medical condition or symptoms linked to a medical condition as defined in its Section 3 (d) and (g) and who, in the doctor’s evaluation, shall receive medical marijuana as treatment.
The two above-mentioned sections define debilitating and non-debilitating medical conditions.
Section 3(d) states that debilitating medical conditions include cancer; glaucoma; multiple sclerosis; damage to the nervous system of the spinal cord, with objective neurological indication of intractable spasticity; epilepsy; positive status for human immunodeficiency virus or acquired immune deficiency syndrome; post-traumatic stress disorder; rheumatoid arthritis “or similar chronic autoimmune inflammatory disorders,” diseases that require hospice care admission; and other conditions that may be identified by the Department of Health through the Medical Cannabis Office.
