THE Department of Human Settlements and Urban Development (DHSUD) on Tuesday hailed the Court of Appeals’ dismissal of a petition for certiorari filed against the agency by the Multinational Village Homeowners Association Inc. (MVHAI) in July.
MVHAI was headed by Julio Templonuevo and Carmelo Marquez.
The case stemmed from a DHSUD memorandum ordering Templonuevo and Marquez to turn over records, documents and properties of MVHAI to the agency before the group’s election of its board members.
Arnel Gacutan, president of the MVHAI Board of Directors in 2019, was tasked to conduct the election.
Previously, Gacutan was ordered by the Human Settlements Adjudication Commission to cease and desist from performing the functions of the MVHAI board.
However, the appellate court reversed the order and other HSAC directives emanating from the original case.
The DHSUD said the decision was upheld by the Supreme Court.
With the Court ruling making the order final, a writ of execution was issued by the DHSUD against Templonuevo and Marquez.
The duo’s continued refusal to comply prompted the issuance of a break-open order on August 6, leaving no impediment for DHSUD to enforce its mandate.
