GMA ‘contractors’ accused of sexual harassment seek to dismiss charges

Lawyers representing Richard Cruz and Jojo Nones, GMA Network’s consultants accused of sexual harassment by actor Sandro Muhlach, are requesting that the latter provide stronger evidence to support his claims.

Their lawyer, Maggie Abraham Garduque, claimed that Sandro’s statements contradicted his complaint.

“Mr. Nones and Cruz dispute all the allegations in the complaint and move for the dismissal thereof not only for lack of evidence, but worst due to the fact that the own evidence of the complainant is contrary to his allegations in the complaint,” said Garduque.

On the other hand, in a report released by Inquirer, the lawyer also pointed to a text message where Sandro supposedly asks to visit Nones and Cruz’s room, contrasting with his claim of being invited.

“I don’t want to go to details, but I just want to say that in every proceeding, whether that is administrative or criminal, the person who alleged has the burden to prove. In the formal complaint, one of the allegations of Mr. Muhlach was he was lured by our clients to go up to the hotel room,” Garduque said.

“However, his own evidence proves otherwise. Based on the text messages, it was Mr. Muhlach who messaged Mr. Nones with ‘Andyan pa ba kayo sir? Baka po pwede dumaan saglit,” she added.

The lawyer also promised to present additional evidence to support their dismissal request.
