Lawyer Stephen David on Friday said dismissed Bamban Mayor Alice Guo did not post bail because it is still not “urgent.”

In a phone interview, David said even if Guo posted the P180,000-bail or P90,000 for each count of graft, she still won’t get her temporary liberty.

He said Guo has another arrest warrant from the Senate, which requires her to be restricted in their detention facility.

Asked if Guo wants to be under the Philippine National Police (PNP) or Senate custody, David said he cannot answer it since it is the choice of his client: “But the facility where she will be detained is the call of the court.”

The lawyer said he has a feeling his client wants to stay in the Senate where her sister Shiela Guo remains. Shiela was placed under Senate custody following her apprehension in Indonesia together with Cassandra Li Ong, who has been at the Congress detention facility.

However, David said Guo has no power to choose, saying “it will always be at the discretion of the authorities.”

He also said it is the court that will decide if Guo will be allowed to attend the Senate hearing on Philippine offshore gaming operators (POGOs) on Monday.
