Former Ako Bicol Representative Alfredo Garbin Jr. is set to formally assume office next week as mayor of Legazpi City in Albay following the disqualification of Carmen Rosal in the May 2022 national and local polls.

The Commission on Elections (Comelec) on Thursday said it ordered the special city board of canvassers (SCBOC) of Legazpi City to convene at the Palacio del Gobernador in Intramuros, Manila on Monday, Nov. 11, to proclaim Garbin as the duly-elected mayor of Legazpi City.

Also to be implemented is the disqualification of Noel Rosal as Albay governor, and Jose Alfonso Barizo as Legazpi City councilor.

“With the issuance of the Writ of Execution relative to the Certificate of Finality and Entry of Judgment on May 10, 2023 in SPA No. 22-032 (DC), the COMELEC constituted and directed the SCBOC of Legazpi City to convene on November 11, 2024 to implement the disqualification of Noel Rosal as Governor of Albay, Carmen Geraldine Rosal as Mayor of Legazpi City, and Jose Alfonso V. Barizo as Councilor of Legazpi City, during the 2022 National and Local Elections,” the poll body said.

In October, the Supreme Court affirmed the disqualification of Carmen Rosal, her husband Noel Rosal, and Jose Alfonso Barizo in the 2022 NLE for violating the Omnibus Election Code “in relation with the disbursement and release of government funds during the prohibited period before a regular election.”

Noel won as Albay governor in the 2022 elections but was later disqualified by the Comelec for violating the election spending ban. He was also barred from holding any public office by the Office of the Ombudsman due to illegal reassignment of personnel.

Meanwhile, his wife Carmen was also disqualified by the poll body after “giving money to influence, induce, or corrupt voters.”

This stemmed from a two-day Tricycle Driver’s Cash Assistance Payout, wherein she was credited for and was tagged as “Mayor Gie Rosal” in a social media post even if she was not an incumbent mayor at the time. — VDV, GMA Integrated News
